Please read these Terms and Conditions ("Terms") carefully before using the Habit Doom mobile application ("App") and website operated by Habit Doom ("us", "we", or "our"). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By downloading, installing, or using Habit Doom, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you are using the App on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

Habit Doom is a habit-tracking application that uses Apple's Screen Time API (Family Controls framework) to help users build positive habits by temporarily restricting access to selected apps until habits are completed. The App:

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use Habit Doom. By using the App, you represent and warrant that you meet the age requirement and have the legal capacity to enter into these Terms. Habit Doom uses PostHog to collect anonymous, non-personally-identifiable event data for the purpose of product improvement. By using the App, you consent to the collection of anonymous usage analytics as described in our Privacy Policy. You may opt out of analytics collection through the App settings at any time.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HABIT DOOM, ITS DEVELOPERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, including but not limited to:

Our total aggregate liability for all claims arising out of or relating to these Terms or the App shall not exceed the greater of (a) the amount you paid for the App in the twelve (12) months preceding the claim, or (b) fifty US dollars (USD $50).

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the App is distributed, without regard to conflict of law provisions. Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration authority in the governing jurisdiction, except where prohibited by law.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action.

If any provision of these Terms is found to be unenforceable, invalid, or illegal by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall remain in full force and effect.

17. Waiver

The failure of Habit Doom to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Habit Doom.

You may not assign or transfer these Terms or your rights hereunder, in whole or in part, without our prior written consent. We may assign these Terms, in whole or in part, at any time without notice. These Terms are binding upon and inure to the benefit of the parties and their respective successors and permitted assigns.

19. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last Updated" date. For significant changes, we may also provide notice within the App. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Habit Doom regarding the use of the App and supersede all prior agreements, understandings, representations, and warranties, both written and oral, with respect to the subject matter hereof.
